Lingua International Terms and Conditions
The following Terms and Conditions describe your responsibilities and our limits of liability among other things. Please read it carefully before submitting a registration form, continuing any further, or using any of the information herein.
General Information
All material provided on this Site
is held by Lingua International. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of Lingua or the copyright owner. You may not, without Lingua's permission, "mirror" any material contained on this Site on any other server. Any unauthorized use of any material contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
Registration
To subscribe to linguaintl.com, you must submit a complete Lingua International registration form on behalf of yourself, the entity or business subscribing ('Subscriber') to Lingua International. By submitting a registration form, you represent and warrant (a) that you are 18 or over, (b) that you are authorized to sign for and bind the Subscriber, and (c) that Subscriber's business is authorized to operate as identified on the registration form. Subscriber shall provide current, complete and accurate information, and then update the information (including credit card information, if applicable) as required to keep the registration information current, complete and accurate. Lingua Internationalwill evaluate the submitted registration form in good faith and will notify Subscriber in a timely manner regarding acceptance or rejection. Lingua may reject a submitted registration form if it determines (at its sole discretion) that the subscriber is not an appropriate subscriber or user of linguaintl.com. If Lingua rejects Subscriber's submitted registration form, then Subscriber may reapply, and Lingua will consider the resubmitted registration form.
Trademarks & Intellectual Property Rights
The Site contains or may contain information, text, photographs, designs, graphics, images, sound and video recordings, animation and other materials and effects (including logos) that are protected by copyrights, trademarks, service marks, trade dress or other intellectual or proprietary rights of Lingua International or other third parties. You acknowledge and agree that these rights belong to their respective owners and are protected in all forms, media and technologies existing now or hereinafter developed. You acknowledge that your unauthorized use of any materials contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and certain communications statutes and regulations, and agree that your use of the Site will comply with all applicable laws.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL LINGUA BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF LINGUA OR A LINGUA AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Governing Law
The laws of the United States of America and the Commonwealth of Pennsylvania (excluding its choice of law rules) will govern interpretation and enforcement of this Agreement. Subscriber hereby consents to personal jurisdiction in the federal and state courts of Pennsylvania for any action arising out of, or relating to, Lingua. The federal and state courts of Pennsylvania will have non-exclusive jurisdiction over all such actions. In any such action, the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to its costs, both taxable and nontaxable, and reasonable attorneys' fees.
Termination
This limited license terminates automatically, without notice to you, if you breach any of the above mentioned Terms and Conditions.
Changes and Revisions
You agree that Lingua may make improvements and/or changes to the Site and its contents at any time without notice, and further agree that Lingua can revise these Terms at any time without notice by updating this posting. You agree that your continued use of the site constitutes your acceptance of such revised Terms.
